Terms of Service & User Agreement

1. Eligibility & Account Registration

1. Age Requirement: You must be at least eighteen (18) years of age—or the age of legal majority in your jurisdiction, whichever is greater—to create an account, post listings, communicate with users, or otherwise use the Platform.
2. Account Verification: You agree to provide accurate, current, and complete information during registration. The Company reserves the right to request proof of age and identity at any time.
3. Account Responsibility: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately if you suspect unauthorized access to your account.

2. Nature of the Platform (Listing-Only Venue)

1. Classifieds / Venue Only: The Platform operates purely as an online classifieds and community venue to facilitate listings, peer-to-peer communications, and display of personal prepper collections (e.g., “Battle Boxes,” gear showcases).
2. No Payment Processing: The Platform does not process payments, hold funds, provide escrow services, charge buyer/seller transaction fees, or intermediate financial trades between users. All financial transactions, shipping arrangements, and exchanges occur entirely off-platform between buyers and sellers.
3. No Party to Transactions: The Company is not a buyer, seller, broker, or agent in any transaction between users. We do not endorse, inspect, verify, warrant, or guarantee any listed items, seller claims, or buyer solvency.

3. Regulated Items & FFL Transfer Mandate

The Platform permits the listing of lawful firearms, regulated frame/receivers, and regulated items under a strict Licensed Transfer Protocol:

1. Mandatory FFL Transfer: Any listing involving serialized firearms, regulated frames/receivers, suppressors/NFA items, or ammunition (where state/local law mandates licensed transfer) MUST be completed through a licensed Federal Firearms Licensee (FFL). Direct-to-consumer shipping or illegal private transfers of regulated firearms are strictly prohibited.
2. Seller Shipping Obligations: Sellers listing regulated items agree to ship items only to the verified physical business address of a valid FFL dealer chosen by the buyer.
3. Compliance with Local Laws: Both buyer and seller agree to comply with all applicable local, state, federal, and international laws, including but not limited to:
   • State and local assault weapon or magazine capacity restrictions.
   • Background check, waiting period, and age requirements (e.g., 21+ for handguns under federal law).
   • Interstate shipping regulations and the Gun Control Act of 1968 (GCA).
4. “Engaged in Business” Prohibitions: Private sellers affirm that they are listing personal property or collection pieces and are not operating as an unlicensed commercial firearm business in violation of federal law.

You are strictly prohibited from listing or displaying content that contains or promotes any of the following:

5. Financial Disclaimers & Offline Safety

1. Peer-to-Peer Scams & Risk: Because all payments occur off-platform, you assume 100% of the risk regarding fraud, non-delivery, counterfeit goods, or misrepresentation.
2. No Refund or Dispute Resolution: The Company will not arbitrate, mediate, refund, or investigate financial disputes or non-performance between buyers and sellers.
3. Payment Processor Warnings: Users are cautioned that mainstream third-party payment services (e.g., PayPal, Venmo, CashApp, Stripe) explicitly prohibit payments for firearms, ammunition, and certain tactical items. Using such services is at your own risk and may result in frozen funds or account termination by those processors.
4. In-Person Safety: If conducting local, face-to-face exchanges for non-regulated gear, users are urged to meet in well-lit public places or designated police station “safe exchange zones.”

6. No Warranty of Emergency Gear / “As-Is” Disclaimer

1. “AS-IS” Status: ALL LISTINGS, CONTENT, AND GEAR DISPLAYED ON THE PLATFORM ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND.
2. Emergency Gear Disclaimer: Prepper, survival, tactical, water filtration, medical, radio communications, and safety gear posted on the site are purchased for high-stakes environments. The Platform makes no warranties or representations that any item bought, traded, or showcased on the site will perform, function, or save lives during a real emergency, natural disaster, or tactical situation. Caveat Emptor (Buyer Beware).

7. User-Generated Content & Community Showcases

1. Showcase / “Battle Box” Posts: Users may share photographs of their collections, tactical gear, and emergency setups. By posting content, you grant the Company a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content on our Platform and promotional channels.
2. Prohibited Community Conduct: You agree not to post content that promotes illegal firearm conversions, dangerous illegal activities, hate speech, harassment, or dangerous tactical advice that violates federal or state law.

8. Law Enforcement Cooperation & Termination

1. Termination Rights: The Company reserves the right, in its sole discretion, to suspend, terminate, or ban any user account, and delete any listing or post at any time without prior notice or liability.
2. Cooperation with Authorities: We take illegal arms trading, fraud, and illegal activity seriously. We will fully cooperate with law enforcement agencies (including the ATF, FBI, and local police) investigating criminal activities, including surrendering IP addresses, user communications, and account data upon receipt of a valid subpoena, court order, or warrant.

9. Indemnification & Limitation of Liability

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless 210 Gear, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in any way connected with your use of the Platform, your listings, your off-platform financial transactions, or your violation of these Terms or applicable laws.
